What is Arbitration?
Arbitration is a way to solve a dispute privately between two or more parties without going to court. The parties can freely agree to submit their dispute to the decision of one independent and impartial expert named arbitrator. The decision rendered by the arbitrator will be final and binding for the parties and will have the same effect of a court decision. The arbitration process can also take place online as any face to face arbitration process.

How does it work?
To file a claim

You sign electronically GEDR Terms & Conditions for the provision of our Arbitration services.

You provide us with your credit card details in order to secure the payment of your fee, equal to 10% of the value of the dispute. The amount will be charged!

You provide us with the email address of your counterparty so that we can notify your claim.

You access our platform to generate and file your Statement of Claim, through our automation process that will guide you and assist you in each step.

We notify your claim to your counterparty.

Scenario 1

Your counterparty receives your claim and accepts to solve the dispute through GEDR.
Arbitration starts!!! Go to Step 8

Scenario 2

Your counterparty receives your claim and rejects to solve the dispute through GEDR or we cannot notify your claim to the address you provided us: Arbitration cannot start and your paid amount will be reimbursed. If you want you can always invite your counterparty to mediate the dispute.

Arbitration. If your counterparty has accepted to solve the dispute through GEDR, this is what happens next:

Acceptance of the case

We will examine the dispute submitted in order to accept the case or not. If we do not accept the case, as it is our right under the Terms & Conditions, your paid amount will be reimbursed. If we accept the case, you will receive a formal notice and we will move forward with the appointment of the arbitrator.

Arbitrator appointment

We will select and appoint an independent expert as arbitrator to your case. Once the arbitrator is assigned, you will receive a notice and you will be able to see the answer of your counterparty to your claim, so -called Statement of Defense.

If we cannot assign an arbitrator to your case, as set forth under the Terms & Conditions, your paid amount will be reimbursed and you could always invite your counterparty to mediate the dispute.

Exam of the evidence

The designated arbitrator examines the case and assesses evidence provided by both parties. During this phase, you might be contacted through our platform by the arbitrator who could ask you some questions or to provide more evidence. In certain cases, oral hearings might take place by video conference call. Except if requested by the arbitrator, none of the parties can contact nor reach out the arbitrator.

Final decision

Once the arbitrator has finally decided and solved the dispute, you will receive a notice along with the issued final decision, called Arbitration Award

Enforcement and fees

The issued Arbitration Award will be binding for both parties and enforceable before the competent court. If you win the case, your paid amount will be reimbursed!
